Welcome to the FoundersandPearls.com website (the “Site”). This Site is maintained and operated by Founders and Pearls LLP. (“FOUNDERS AND PEARLS”).

 

By accessing, browsing or using this Site, you acknowledge that you have read, understand and agree to be bound by these Terms of Use (the Terms). If you do not agree to the Terms, you should not use or access this Site. FOUNDERS AND PEARLS reserves the right to revise these Terms at any time by updating this posting. You are encouraged to review the Terms each time you use the Site because your use of the Site after the posting of changes will constitute your acceptance of the changes. We grant you a personal, limited, non-transferable non-exclusive, license to access and use the Site. We reserve the right, in our sole discretion and without notice to you, revise the products and services available on the Site and to change, suspend or discontinue any aspect of the Site and we will not be liable to you or to any third party for doing so. We may also impose rules for and limits on use of the Site or restrict your access to part, or all, of the Site without notice or penalty. Your continued use of the Site will constitute your acceptance of any such changes.

FOUNDERS AND PEARLS provides a subscription service for monthly delivery of beauty, inspiration, career, and lifestyle products. Access to the Site, use of the Services, and purchase of the Products is subject to these Terms and Conditions and the FOUNDERS AND PEARLS Privacy Policy available on the Site.

  1. USE OF THE SITE
    You may use the Site only for your own noncommercial personal use and in compliance with the Terms. You are responsible for your own communications, including the transmission, uploading or posting of information and are responsible for the consequences of such communications to the Site. We require all Members to agree not to use the Site, and specifically prohibit any use of the Site, for any of the following purposes:

    • - Posting, communicating or transmitting any material that infringes on any intellectual property, publicity or privacy right of another person or entity

    • - Posting any information which is untrue, inaccurate or not your own

    • - Engaging in conduct that would constitute a criminal offense or give rise to civil liability or otherwise violate any law or regulation

    • - Attempting to interfere in any way with the Site's or Founder and Pearls’ network security, or attempting to use the Site's service to gain unauthorized access to any other computer system

You are responsible for maintaining the confidentiality of your subscription and any passwords associated with it. You agree to accept responsibility for all activities that occur under your subscription account. You agree to immediately notify us in the event of any unauthorized use of your account or other breach of security.

 

  1. ADDITIONAL TERMS AND CONDITIONS
    You agree that additional terms and conditions may apply to specific products, orders or your use of certain portions of the Site, including with respect to ordering, shipping and return policies and membership reward programs ("Additional Terms"), which Additional Terms are made part of these Terms by reference. If there is a conflict between these Terms and the Additional Terms, the Additional Terms shall control.

  2. MEMBERSHIP/SUBSCRIPTION
     

The Site is available to registered users who are 13 years and older and who have not been suspended or removed by FOUNDERS AND PEARLS for any reason (a "Sister"). We reserve the right to revoke your membership for any reason at any time including as a result of a violation of these Terms of the Privacy Policy, without notice. Membership is void where prohibited by law. In order to start your ongoing FOUNDERS AND PEARLS subscription, you must register as a member on our Website when completing payment. To register we ask that you verify sorority membership; choose your shipping information including your preferred mailing address and billing information, and your valid email address and password to create your login profile. For your convenience as a FOUNDERS AND PEARLS sister, all information that you provide to FOUNDERS AND PEARLS is subject to FOUNDERS AND PEARLS’ Privacy Policy. You are responsible for keeping your registration information up to date by emailing us until an account system has been established through the Site.

You may choose to subscribe to a subscription plan through the Service. The subscription plan to our Service consists of one flat fee plus shipping to cover boxes in the subscription plan chosen. By entering into this Agreement, you acknowledge that your subscription has one charge prior to cancellation. We may submit periodic charges (e.g., annually) without further authorization from you, until you provide prior written notice that you wish to terminate this authorization or wish to change your payment method. Such notice will not affect charges submitted before we reasonably could act. To terminate your subscription or change your payment method, email us support@foundersandpearls.com. You can cancel your subscription at any time. You will not be charged for any cancellation. You can re-subscribe at any time following your cancellation, but we reserve the right not to permit re-subscription where we have previously elected to terminate a subscription by you. To cancel your subscription, you must log on to your FOUNDERS AND PEARLS account (if available) or email us at support@foundersandpearls.com and we will do it for you. To cancel your subscription, send your name, email address, and sister number to support@foundersandpearls.com and we will cancel your subscription. You must send your cancellation in before midnight (eastern standard time) on the 15th of the month prior to your next box shipment if you want to cancel and/or receive a refund, which may take up to 30 days. You can find our shipping dates on the shipping calendar emailed to you once you subscribed. We reserve the right at our absolute discretion not to renew your subscription at any time without giving any reasons for our decision.

As a registered user of FOUNDERS AND PEARLS, you agree to receive emails promoting any special offer(s), including third party offers. We may from time to time send you a newsletter. You may opt-out from receiving special promotions or our newsletter by emailing support@foundersandpearls.com or selecting to unsubscribe as may be provided in the applicable e-mail correspondence.

  1. BILLING & PAYMENTS
     

All information that you provide to register with FOUNDERS AND PEARLS including your credit card information is subject to FOUNDERS AND PEARLS’ Privacy Policy. The price of the Services and/or goods is payable in full before delivery. We accept the following credit cards at this time: Visa, MasterCard, American Express, or Discover. You will automatically be charged the full price of your subscription plan of choice. For your convenience and continuous subscription benefits as a member, if your payment method reaches its expiration date and you do not update your credit card information or cancel your subscription, you authorize us to continue billing that credit card on file including extending the expiration date until we are notified by you or the credit card company that the subscription is no longer valid. We encourage you to constantly update your payment method information or cancel your subscription should you wish to discontinue your monthly purchase of Products.

We use a third party payment service in lieu of directly processing your credit card information. By submitting your credit card information, you grant FOUNDERS AND PEARLS the right to store and process your information with the third party payment service, which it may change from time to time; you agree that FOUNDERS AND PEARLS will not be responsible for any failures of the third party to adequately protect such information. All financial matters regarding your information are subject to the conditions of the third party payment service provider’s terms of service. You acknowledge that we may change the third party payment service and move your information to other service providers that encrypt your information using secure socket layer technology (SSL) or other comparable security technology.

  • A) Billing Policies
    Certain aspects of the Service, for example subscription plans, may be provided for a fee or other charge. If you elect to use paid aspects of the Service, you agree to the pricing and payment terms quoted on our Site and as we may update them from time to time. FOUNDERS AND PEARLS may add new services for additional fees and charges, or amend fees and charges for existing services, at any time in its sole discretion. Payment for all products purchased through our Site must be by credit (Visa, MasterCard, American Express or Discover Card) or debit card.

  • B) Refunds

(i) For Subscription Plans. You must cancel by the 1st of the month prior to your box shipping date to avoid being charged for that month’s box. If you cancel after this time and a box is processed, there will not be a refund available. In the event that FOUNDERS AND PEARLS suspends or terminates your subscription or this Agreement for your breach of this Agreement, you understand and agree that you shall receive no refund or exchange for any unused time on a subscription, any license or subscription fees for any portion of the Service, any content or data associated with your account, or for anything else. Two box, Four box and Six box subscriptions can be canceled and are partially refundable. Once a subscription is cancelled consumers will receive a partial refund that reflects the cost of boxes shipped to consumer revert to the one-time box price of $39.95 with an additional $5 shipping cost per box shipped out. The first box shipment of your subscription box plans cannot be canceled and is nonrefundable. One time box purchases are nonrefundable. We do allow 24 hour refunds and are very strict with that time frame for refund request. All refunds will transact within 30 days of approval.

(ii) For Products. You understand and agree that you shall receive no refunds and no exchanges for any Products once we or our supplier(s) delivers these items to the carrier unless the Product received by you. After 30 days, you shall receive no refunds and no exchanges for any Products despite their condition.

  • C) Risk of Loss and Title.
    All products purchased from or via the Service are transported and delivered to you by an independent carrier not affiliated with, or controlled by, FOUNDERS AND PEARLS. The risk of loss for such products passes to you when FOUNDERS AND PEARLS, our brand partner or our supplier delivers these items to the carrier. Title to products purchased on the Service passes to you when we receive full payment of all sums due for such products including any shipping and handling charges.

  • D) Payment Information; Taxes.
    All information that you provide in connection with a purchase or transaction or other monetary transaction interaction with the Service must be accurate, complete, and current. You agree to pay all charges incurred by users of your credit card or debit card, used in connection with a purchase or transaction or other monetary transaction interaction with the Service at the prices in effect when such charges are incurred. You will pay any applicable taxes, if any, relating to any such purchases, transactions or other monetary transaction interactions.

  • E) Payments.
    Payments shall be processed through our site and shall be in the form you select when you either submit an order form or your register a paid Service. FOUNDERS AND PEARLS reserves the right to withhold payment or charge back to your account any amounts otherwise due to us under this Agreement, or amounts due to any breach of this Agreement by you, pending FOUNDERS AND PEARLS reasonable investigation of such breach. To ensure proper payment, you are solely responsible for providing and maintaining accurate contact and payment information associated with your account, which includes without limitation applicable tax information. You agree to pay all applicable taxes or charges imposed by any government entity in connection with your participation in the Service. If you dispute any payment made hereunder, you must notify FOUNDERS AND PEARLS in writing within thirty (30) days of such payment. Failure to so notify FOUNDERS AND PEARLS shall result in the waiver by you of any claim relating to such disputed payment. Payment shall be calculated solely based on records maintained by FOUNDERS AND PEARLS. No other measurements or statistics of any kind shall be accepted by FOUNDERS AND PEARLS or have any effect under this Agreement. We may withhold any taxes or other amounts from payments due to you as required by law.

  • F) Shipping

FoundersandPearls.com offers Free Priority Shipping on the 6 box subscription plan. For 2 box, 4 box, or one time box purchases totaling less than $179, there is a flat delivery charge of $5 for priority 2-3 day shipping per box. All free gifts are shipped free.

  1. PROPRIETARY RIGHTS
    You acknowledge and agree that the content (other than content that may be submitted by Sisters), materials, software and other components (including our graphics, logos, videos, button icons, music and page headers) available on the Site are the property of FOUNDERS AND PEARLS or our licensors and are protected by copyrights, trademarks, service marks, or other proprietary rights and laws. You agree not to sell, license, rent, distribute, modify, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from any content or materials on the Site.

  2. PRODUCT INFORMATION; LIMITATION ON QUANTITIES
    Excluding any content that may be submitted by Members from time to time, we strive to ensure that the information on the Site is complete and reliable. Certain information may contain pricing errors, typographical errors and other errors or inaccuracies that we may correct without liability. We also reserve the right to limit quantities purchased by Members and to revise, suspend, or terminate an event or promotion at any time without notice (including after an order has been submitted and/or acknowledged). We do not guarantee that all products described on our Site will be available.

  3. DISCLAIMERS
    You assume all responsibility and risk with respect to your use of the Site. THE SITE, AND ALL CONTENT, MERCHANDISE, AND OTHER INFORMATION ON OR ACCESSIBLE FROM OR THROUGH THIS SITE OR A "LINKED" SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, SECURITY OR ACCURACY.   4. SUBMITTED CONTENT
    FOUNDERS AND PEARLS does not claim ownership of any materials you make available through the Site.
